WHEREAS, Customer desires to utilize the registration services to develop Customer's presence on the World Wide Web.

NOW, THEREFORE, in consideration of the mutual promises set forth herein, the parties hereto agree as follows:

1. GlobaLink (USA) Corp's Services

GlobaLink (USA) Corp acts as a reseller of domain names and uses AllDomains.com, an ICANN accredited registrar ("registrar") to execute any and all registrations of domain names.

GlobaLink (USA) Corp agrees to provide to Customer with Registration services for various, supported domain names.

2. Payments

Customer shall pay in advance for our services according to our current published rates and as may be amended during the term of this agreement, using one of the payment methods specified in our Payment Policies, which are included herein by reference.

Registration of domain names is always held until payment is received. Upon receiving payment, registration will be submitted through registrar. However customer must be aware that someone may have registered their desired domain before the customer's payment is processed.

Globalink (USA) Corp may disable and/or remove a Customer's domain and any associated services at anytime for a returned check, or chargeback to a credit card.

All prices are in US Dollars. Any credits or refunds are paid in US Dollars regardless of exchange rate fluctuations.

3. Cancellations and Refunds

3.1 Refunds of Registered Domains

Once a domain name is registered GlobaLink (USA) Corp cannot 'un-register' it. Thus Globalink (USA) Corp can not recoup any fees associated with a particular domain. This is why GlobaLink (USA) Corp cannot refund money, even if the customer (for whatever reason, including but not limited to misspelling of the name on the application form) request the domain to be cancelled.

Customer agrees that all sales are final and that no refunds will be given. Furthermore, Customer agrees that no refunds will be granted for cancellations by GlobaLink (USA) Corp due to Customer spamming, or other violations of this agreement by Customer.

3.2 Non Registerable or Rejected Domains

In the event a domain name is not registerable, GlobaLink (USA) Corp will credit the credit card or send a refund if paid by check.

4. Domain Modifications

Customer understands that  he is responsible for communicating to GlobaLink (USA) Corp all modifications to the domain names they register.

5. Responsibilities of Globalink (USA) Corp

5.1. GlobaLink (USA) Corp shall provide Customer with the Service as set forth on its website and shall perform its services to the best of GlobaLink (USA) Corp's ability.

5.2. GlobaLink (USA) Corp reserves the right to refuse service to anyone at any time. However, if GlobaLink (USA) Corp should initiate termination of services with you, GlobaLink (USA) Corp will provide reasonable notice to you in order to allow you to initiate services elsewhere.

6. Responsibilities of the Customer

Customer shall be solely responsible for all domains registered on or through the GlobaLink (USA) Corp service, and shall at all times be subject to the terms of this Agreement

6.1. Customer agrees not to use the Registration service in any manner that is illegal or libelous. Although GlobaLink (USA) Corp does not actively police registrations, we do not support or condone the registering of trademarks, or intellectual property not belonging to the customer.

6.2. Customer warrants that the domain registered with the Registration Services will not infringe or contain any content that infringes on or violates any copyright, U.S. Patent any third-party right, or violates any applicable law, rule or regulation.
GlobaLink (USA) Corp reserves the right to block any domain that violates any of the above-stated terms, or which in GlobaLink (USA) Corp's sole discretion, GlobaLink (USA) Corp deems objectionable or offensive, or otherwise violates a law or GlobaLink (USA) Corp's policy.

6.3. Customer agrees to abstain from using the domain for conduct such as send mass, unsolicited emails (SPAMMING), sending chain letters, violating the security of either GlobaLink (USA) Corp or other organization systems and computers.

7. Warranties and Indemnification

7.1. IN NO EVENT WILL GLOBALINK (USA) CORP'S LIABILITY TO CUSTOMER ARISING OUT OF THIS AGREEMENT EXCEED THE AGGREGATE AMOUNTS PAID TO GLOBALINK (USA) CORP HEREUNDER. IN NO EVENT WILL GLOBALINK (USA) CORP BE LIABLE FOR LOST PROFITS OR LOST BUSINESS OPPORTUNITIES ARISING OUT OF THE TERMINATION OF THIS AGREEMENT. IN NO EVENT WILL GLOBALINK (USA) CORP BE LIABLE UNDER OR IN CONNECTION WITH THIS AGREEMENT FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, RELIANCE, EXEMPLARY, PUNITIVE OR OTHER INDIRECT DAMAGES OF ANY NATURE, FOR ANY REASON, INCLUDING WITHOUT LIMITATION THE BREACH OF THIS AGREEMENT OR ANY EXPIRATION OR TERMINATION OF THIS AGREEMENT, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT (INCLUDING NEGLIGENCE OR STRICT LIABILITY) OR OTHERWISE, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.2. DISCLAIMERS
GLOBALINK (USA) CORP MAKES NO EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO THE PROGRAM OR ANY PRODUCT OR SERVICE OF GLOBALINK (USA) CORP, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF FITNESS, MERCHANTABILITY, NONINFRINGEMENT, OR ANY IMPLIED WARRANTIES ARISING OUT OF A COURSE OF PERFORMANCE, DEALING OR TRADE USAGE. GLOBALINK (USA) CORP MAKES NO REPRESENTATION THAT THE CUSTOMER SITE WILL BE UNINTERRUPTED OR ERROR-FREE, AND GLOBALINK (USA) CORP SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS.

7.3. YOU AGREE TO USE GLOBALINK (USA) CORP'S SERVICES AT YOUR OWN RISK. IN NO EVENT SHALL GLOBALINK (USA) CORP BE LIABLE FOR ANY LOSS OF DATA, EMAIL, OR FILES, VIRUS INFECTION, DELAYS OR PERFORMANCE PROBLEMS DUE TO POWER OUTAGES, ACTS OF GOD, COMMUNICATIONS FAILURES, THEFT, OR DESTRUCTION OF PROPERTY.

8 Term and Termination

8.1. This agreement is effective when you first use GlobaLink (USA) Corp's Registration Service and continues until the domain is transferred to another registrar.

8.2. GlobaLink (USA) Corp may terminate the Agreement immediately if any of the terms of this contract are not met.

9 Uniform Domain Name Dispute Resolution Policy

You agree to be bound by  the Terms and Conditions set forth in the Uniform Domain Name Dispute Resolution Policy as approved by ICANN.
